Sales Tax Exemption & Resale Certificates

 

If your organization qualifies for a Texas sales tax exemption, or if you purchase decorated items for resale to your own customers, you may be required to provide a completed certificate before your order is processed.

Who Needs to Submit a Certificate?

  • Resellers – Businesses that purchase decorated apparel or goods to resell to their own customers should complete a Texas Sales and Use Tax Resale Certificate (Form 01-339). You will need an active Texas sales tax permit number to complete this form.
  • Exempt Organizations – Certain organizations are exempt from paying Texas sales tax on qualifying purchases and should complete a Texas Sales and Use Tax Exemption Certification (also Form 01-339). Organizations that may qualify include:
    • Texas state and local government entities, public school districts, and public universities (automatically exempt — no prior approval required)
    • Qualifying nonprofit organizations, including those with IRS 501(c)(3), (4), (8), (10), or (19) status — but only after receiving a Texas Comptroller-issued exemption letter
    • Youth athletic organizations that have applied for and received Texas exemption status
    • Qualifying religious and charitable organizations with Texas Comptroller approval

Important note for sports leagues, booster clubs, and youth organizations: Having a federal tax ID number (EIN) or IRS nonprofit status does not automatically mean your organization is exempt from Texas sales tax. Nonprofit organizations must separately apply for and receive exemption status from the Texas Comptroller before making tax-free purchases. You can verify your organization’s status using the Texas Comptroller’s Exempt Organizations page.

How to Submit Your Certificate

  1. Download Form 01-339 using the link below.
  2. Complete and sign the form with your organization’s information, including the reason for exemption.
  3. Email the completed certificate to quote@skywaytx.com, upload it via the quote request form, or bring it in person prior to or at the time of your order.

A certificate on file with us covers future orders as long as your exempt or resale status remains valid. If your status changes, it is your responsibility to notify us. We are required to keep all certificates on file for a minimum of four years.

 As a seller, we accept properly completed certificates in good faith. Responsibility for the accuracy of the claimed exemption rests with the purchaser. Improperly claimed exemptions may result in tax liability for your organization.
